The Divorce Process

Some divorces are very simple and can be handled relatively quickly. Other divorces are much more complicated and can take longer, such as when there are child custody issues or large amounts of property. Each divorce takes its own course depending on the parties involved.

The initial step is for one of the spouse’s to contact an attorney who will than draft a Petition and file it with the Court. Next, the other spouse will be served and have an opportunity to respond. The Petition will state the grounds for the divorce and the relief sought. After filing Petitions and responding, the parties engage in discovery. During this time relevant information is exchanged between the parties. At anytime during the process the parties may decide to settle the case. If no settlement can be reached, there will be a trial. A Judge must approve all Marital Settlement Agreements when parties decide to settle a case.

Child custody and support

Determining child custody is a very emotional and difficult time. The focus is on the best interest of the child. The Court will weigh many factors when making this decision, and will ultimately whatever is in the best interest of the child is the arrangement that will be granted.

Either or both parents may be ordered to pay child support. Child support is calculated based on the Guidelines that are set out by statute. In some instances, there may be cause to deviate from the guidelines. Again, the Court will carefully weigh each factor to make sure that the decision is in the child’s best interest
