A home is one of the largest investments you will ever make, it is important to know your rights and have them explained to you by a real estate lawyer. You will likely have several questions you need answered and an experienced real estate attorney can help you.
For Seller:
- Negotiate Contract;
- Order and clear title;
- Order payoffs from all lenders and order all required documents from condo association (if applicable);
- Provide client with all necessary paperwork to purchase municipal transfer stamp (if applicable);
- Provide client with a quote from a preferred survey company;
- Prepare all required closing documents, including but not limited to Deed, Bill of Sale, Affidavit of Title and the like;
- Attend closing with, or, if necessary or desired, without client, to ensure proper transfer of title; and
- We never charge for minor post-closing issues.
For Purchaser:
- Negotiate Contract;
- Carefully monitor deadlines for home inspection, financing and home sale contingencies;
- Review title for possible defects;
- Provide client with all necessary paperwork to purchaser municipal transfer stamp (if applicable);
- Review survey for possible encroachments;
- Review all closing documents, including but not limited to Deed, Bill of Sale, Affidavit of Title and the like;
- Attend closing with client to review and explain all lender documents and to ensure proper transfer of title; and
- We never charge for minor post-closing issues.
For the Commercial Seller/Purchaser:
- Draft commercial contracts; including but not limited to asset purchase and stock purchase agreements;
- Negotiate Contract;
- Monitor deadlines for all contingencies;
- Review leases and lease assignments;
- Order employment security and Bulk Sale releases from State;
- Order/review UCC searches to ensure clear title to assets;
- Prepare all necessary closing documents, including corporate resolutions; and
- Attend closing to ensure proper transfer of title and leasehold interests.
